A preliminary hearing takes place in the High Court of Justiciary in solemn proceedings and is to decide if the case is ready to go for trial.

Also preliminary legal or factual issues may be determined before trial at a preliminary hearing.

16-year-old Bailey Gwynne was fatally injured during an incident at Cults Academy on Wednesday, October 28, last year.

Following the incident, a fellow pupil was taken into police custody and appeared in Aberdeen Sheriff Court the following Friday (October 30).

He made no plea and appeared in Aberdeen Sheriff Court again on Friday, November 6.

Cults Academy reopened to pupils on Monday, November 2.

In the aftermath of the incident, hundreds attended a service at Cults Parish Church to light a candle for Bailey, remembering and honouring their lost friend and pupil.

Cults Academy pupils made up the majority of the congregation, alongside parents, members of the local community, and people from outwith the area.

They numbered so many, that all the chairs were taken up, with many people huddled together on the floor and on the stairs.

They were encouraged to write on the message boards, to leave notes of condolence for Bailey’s family.
